1. Who we are, and what this covers

When we say "FirstSnag", "we", "our" or "us", we mean [Owner legal name], a sole proprietor in [State], doing business as FirstSnag. "The app" means our software for Windows and its updates. "The website" means firstsnag.com. "The services" means the app, the website, license keys, the referral and creator programs, and our support.

These Terms of Service ("terms") are an agreement between you and us. They include the license for the app. By downloading, installing or using the app, or by buying Pro, you agree to them. If you don't agree, please don't use FirstSnag.

2. Who can use it

• You need to be 18 or older, or the age of majority where you live, to agree to these terms and to buy Pro.
• If you're younger, a parent or guardian must agree to these terms for you, and is responsible for your use and any purchase. You must be at least 13.
• You're responsible for your computer, your Facebook account, your license key and anything done with them.

3. Your license to use the app

The app is licensed to you, not sold. We give you a personal, limited, non-exclusive, non-transferable and revocable license to install and use it for your own use, including finding things to buy for yourself and to resell yourself.

• Free: 1 search, checked about every 15 minutes.
• Pro: up to 25 searches, on up to 2 computers that you own or control. With 5 or fewer searches, each one is checked about every 5 minutes. On every plan the app loads at most 60 pages an hour in total, so with more searches each one is checked less often (for example, about every 10 minutes with 10 searches).

You agree not to:

• copy, sell, rent, lend, sublicense or share the app or your license key;
• reverse engineer, decompile or modify the app, except where the law allows it despite this restriction;
• get around license checks or plan limits, or make the app check websites faster than it allows;
• use the app to collect, store, publish, sell or share data from Facebook or any other website, or to build a database, product or service from it;
• use the app to spam, harass, mislead or scam anyone, including sellers;
• use the app for anything illegal.

Some parts of the app are open-source software with their own licenses. We list them in the app, and those licenses apply to those parts.

4. Facebook and other websites

The app works with websites you choose to use it with, mainly Facebook Marketplace. It opens them in a separate browser window on your PC, signed in to your own account, which you sign in to yourself. We never ask for or receive your password.

We are not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. Facebook and Marketplace are trademarks of Meta Platforms, Inc.

• Their terms apply to you. Every website has its own terms and rules. Facebook's terms don't allow automated access to, or collection of data from, their site without their permission. You alone decide whether to use the app with any website, and you're responsible for following that website's terms and rules.
• Your account is at your own risk. Facebook or any other website may limit, restrict, suspend or close your account, or change their site in a way that stops the app from working. We don't promise the app will keep working with any website, and we're not responsible for anything a website does to your account.
• We don't control listings. Prices, photos, descriptions and seller details come from sellers and the website. We aren't part of any deal you make. Meet safely, and never pay before you've seen the item.
• Links to other sites (like eBay, NICB or NHTSA) are there to save you time. Those sites have their own terms and privacy policies.

5. Deal scores, vehicle data and alerts

Deal labels, typical prices, comparisons, warnings and "why it alerted" notes are automatic estimates, based on the listings the app has seen. They can be wrong. Vehicle information from NHTSA comes from the US government, as is. Nothing in the app is financial, legal or mechanical advice.

Alerts can be late or missed, for example when your PC sleeps, your internet drops, Facebook asks you to sign in again, or a website changes.

6. Pro subscriptions, automatic renewal and cancelling

Price and payment

Pro costs $10 a month or $79 a year in US dollars, plus any sales tax, as shown at checkout. Orders are processed by our reseller, Lemon Squeezy, which is the merchant of record for your purchase. It handles checkout, payment, sales tax and receipts, and its own buyer terms also apply. We never receive your full card details.

Automatic renewal

Your subscription renews automatically at the end of each billing period (every month or every year) at the then-current price, and the payment method on file is charged, until you cancel. For yearly plans we email you a reminder 15 to 45 days before the renewal date.

Cancelling

You can cancel anytime, online, from the link in your receipt email or the customer portal, or by emailing support@firstsnag.com. Cancelling stops the next renewal. Pro keeps working until the end of the period you've paid for, then switches to Free. Except as described in our Refund Policy or required by law, we don't refund unused time.

Price changes

If we change the price of Pro, we'll tell you at least 30 days before the new price applies to you, so you can cancel before it does.

Failed payments

If a renewal can't be charged, we may try again a few times and then switch your license back to Free.

Credits

Free months from referrals or promotions apply to future billing periods. They have no cash value.

7. Referral and creator programs

If you take part in our referral program or creator program, the Referral Terms or Creator Terms also apply. We may change or end either program as those terms describe.

8. Updates and changes to the services

We update the app to fix bugs, keep up with changes to websites and make it better. Some updates may be required to keep using it. We may add, change or remove features. If we ever stop offering Pro altogether, we'll refund the unused part of any time you've paid for in advance.

9. Your data

The app keeps your searches, listings, settings and its browser profile on your PC. Our Privacy Policy explains what we do and don't receive. You're responsible for backing up anything on your computer that matters to you.

10. Ending your use

You can stop using FirstSnag anytime: cancel Pro and uninstall the app. We may suspend or end your license if you break these terms, abuse the referral or creator programs, commit fraud, or file chargebacks for payments you authorized. When we can, we'll tell you why. Parts of these terms that by their nature should last after your use ends (like sections 4, 5, 11, 12 and 13) keep applying.

11. No warranties

To the fullest extent the law allows, the services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the services will be uninterrupted, error-free or secure, that they'll keep working with any website, or that you'll find any particular deal.

12. Limits on liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals, lost data, or restrictions on or loss of any account with another website, arising from or related to the services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US $20 if you haven't paid us anything.

If you break these terms or a website's terms, or misuse the app, and someone makes a claim against us because of it, you agree to cover our reasonable costs, including legal fees, where the law allows. Some places don't allow some of these limits; in that case they apply only as far as the law allows.

13. Disputes and governing law

If something goes wrong, email us first. We'll try to sort it out informally within 30 days. These terms are governed by the laws of the State of [State], USA, without regard to its conflict-of-law rules, and the state and federal courts there have jurisdiction. Nothing here takes away rights you have under the consumer laws of the place you live.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. These terms, together with the policies they link to, are the whole agreement between us about the services. You can't transfer them; we may transfer them if the business changes hands.

14. Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app at least 14 days before it takes effect. If you keep using FirstSnag after that, the new terms apply. The date at the top shows the latest version.
